@Mary Mitchell

We asked her to do a final walk through and turn over keys so she wouldn’t have any liability to damage during showings or while she is not living there.

She said she would do that as long as we would refund any rent due if she was handing over keys prior to the end date of her lease.

After hearing everyone’s input it sounds like I should continue giving her the 24 hour notice and just schedule at our convenience. I don’t need to let her know exact time so she can be present. We have 8 days left on the lease so we’ll just get through it and hopefully move onto a new tenant!

@Daryl Luc

She has been a very high maintenance client for quite some time so we are relieved to have a new tenant.

I don’t know what her beef is other than she has expressed concern that she’ll be liable for any damage that could happen during showings. Not sure how unit could get damaged. I think she’s doing everything she can to ensure she gets her entire deposit back.

Weird situation but just trying to make sure I’m not crossing any legal lines.

Thanks for your input!

@James Wise

She is not living there and the unit is empty but she is in possession because she is still under lease. We are giving the 24 hour notice but she is requesting to be present at the showings.

Everything that I have read says that we are only required to give notice (24 hours per our lease) and not that she has any right to be there during a showing.

Thanks for your input!

@James Wise

Sorry for the confusion.

She has moved out and the unit is empty. She moved out 4 weeks before the end of her lease. Yes it is written in lease agreement to give 24 hour notice.

I have a Tenant here in Kansas City who moved out before lease was up. She has paid all rents that are due under the lease. Unit is empty and we are showing prospective tenants. Current tenant who is still under lease is requesting to be present at all showings which would require us to work around her schedule. We are giving her 24 hour notice of showings and are scheduling these at the convenience of prospective tenants.

Do we have to accommodate current tenants request to be present of showings of our empty unit?
