LL sent me a 3 day notice for unpaid rent. Notice is written "demanding" rent or "possession of the premises". Of course, I paid the rent. I'm curious if I move out and vacate the premises, can I then sue my landlord for illegal eviction? Or, must I wait for the legal eviction process to complete? In other words, have I been evicted if LL demands possession of the premises?

Rest of the story, if you're interested. Requested to add a tenant (new wife) and LL asked for an additional $1600 security deposit. Fine, LL within his rights. Sent me lease addendum...but I didn't sign it (this is important). More of the story, new wife didn't have SSN, only ITIN. LL rejected using ITIN and would only use SSN. Without SSN, LL said "no credit history" and asked for $1600 extra security deposit. Well, new wife has been using ITIN to establish credit including Chase and BoA bank accounts and even unsecured credit lines (credit cards) of both $2800 and $1500. Like I said, LL dismissed using ITIN - which has a credit profile. More details, ITIN credit profile can be transferred over to SSN (when obtained) by contacting the three CB's. LL put $1600 in their on-line portal and subtracted that $1600 from my June rent payment. I still paid my normal rent for June, but the total came up short of exactly the $1600. Now LL has issued pay or vacate.

You can have a state ID, even a Real ID w/o a SSN. If you have a work permit (EAD) pending, you can get a Real ID while you wait for the EAD, which will give you an SSN. EAD's are taking longer than a year to process.

Update to above post:

Assume you are the previous landlord and a new landlord is calling you.

I know employers are very stingy with saying anything about a previous employee. Seems you have almost nothing to gain by giving information and a lot to lose, if perhaps you are actually being called by the renter to record what you say about him/her.

I have a follow up question, perhaps I should post as new, but would anyone be willing to share how I can ascertain whether or not my corporate landlord files a relatively large number of evictions?

It is PRUCOL. This was my first post on the forum and I saw the error after I posted, went to the ... update option and entered the change, but it never materialized in my post.

No need for refugee resettlement, but thanks.

Lease terms are that visitors can only stay up to 15 days/year without being added to the lease. Thanks for your reply.

Renter here.

Facts:

New tenant is spouse of existing tenant. I know doesn't matter, but still...

Existing tenant, 3 years, no late payments, obviously qualified on own income

New tenant does not have an SSN. Has State ID (Real ID), foreign passport. Has USCIS petition for spouse (only application, not approval)

New tenant has ITIN, but 0 credit history. Has Chase bank account and just received Chase credit card, still credit score is 0.

New tenant immigration status is PROCOL. Complicated to explain, but it is PROCOL (it's a court status only) HUD deems new tenant in "sufficient immigration status" for housing assistance programs. Still new tenant is technically "out of status" at the federal level. It's complicated but all 3 of those facts are true.

New tenant has FBI fingerprint backgound check with 0 infractions, but this is an IdHS run for personal information purposes only. Certified letter in hand from Justice Department, but federal agencies are not permitted to use this run for "employment or licensing" purposes. Nothing about private landlords disallowed from using this information as a criminal background check.

New tenant has no rental history in the US. Also not employed.

Legal? Any recourse? Thx.
