Thanks David! That is exactly the problem the architect mentioned. Because the walkway is under 7 feet, it would need a variance which could be difficult to obtain. I'll give it a try and let you know the results. 

Hi All,

I live in Massachusetts and trying to work out a deal... I am trying to understand rules and regs for building a deck. I want to build a deck out on a rooftop of a first floor which is currently a flat roof for the first floor. There is already a deck next to it, however the area that I want to build out has a deck over it for the 3rd floor. The architect mentioned that it will be unlikely that the city would allow me to do this because the deck over me is too low... I would say the hight is about 6.5' to 7.5'. Has anyone ran across this? I am making proposing an over for that particular space to be exclusive for me on the unit purchase so I can build the deck out, however, I just got hit with this news today... Not sure If there are really any regulations for this or not. Picture is attached for clarity. Thanks so much for your help!
