Unfortunately I cannot be the owner-contractor because I do not plan on living in the house for 12 months. I cannot quit claim the the deed to myself or the construction company either because I bought it at a NORA (public) auction with the stipulation that I cannot transfer the title until a certificate of occupancy has been issued.

Do any general contractors have experience on building on a property that you own or have equity in? I am going to sign a contract between the LLC that owns the lot and my contracting company, but I am a bit concerned about taxes. Do I pay my own construction company as if I were a customer, or do I just pay for all construction costs (minus labor) directly from the LLC the property is deeded to? I'm concerned it will be difficult to prove to the IRS that the contracting company did not profit from the job and everything was done at cost.

Hello, 

I am a member of a small real estate development team in New Orleans, La. We do buy and holds, flips, and new construction. We do our property management and construction management in-house. I love this profession because of the endless opportunities to be creative and they let me play with power tools every once in a while.

I actually found out this morning the check had a stop payment ordered instead of it bouncing. Regardless, I think I will move forward instead of wasting time on trying to collect.

Thanks for the advice, everyone. I meant to type "single-member" instead of "sole-proprietor." Anyway, can anyone tell me who exactly has signing authority for LLCs? And is there a way to give someone besides a real estate agent this authority?

I would like to pursue legal action in small claims court, however, I realized I made a mistake on my lease. The property is owned by an LLC (sole-proprietor), but the lease was made out to my name. The lease was also signed my employee, who has had no problem representing me in eviction court. Will I have a chance at collecting my lost income in small claims court and will my employee be able to represent the LLC?
