Thank you Sarah.

I have tried reaching out to her. She tells me (she is 59) she was in and out of the hospital last couple of weeks. Last month she was late with rent ( 7th of the month) because she said she was out of town for the holidays.

I repeatedly ask her to pay rent.

She texted me yesterday to say that she is willing to meet me this Friday to find out "what is bothering me".

The only thing that is "bothering me" is that she is late on rent and hardly ever returns my calls or texts.

Again, thank you kindly  Sarah.

Kevin,

I have not received rent for February yet. However, my tenant had paid 1st, last and deposit when she moved in. However, she has currently late with rent.

My curiosity was whether my tenant could claim that she is not 8 days late because she paid 1st AND last when moving in a few months ago.

Thanks a million for your reply, Kevin. It was excellent.

Missy,

I was kind of leaning towards that kind of thinking but i was not 100% sure. It makes sense.

Thank you for going to the trouble of replying.

Thank you Al for taking the time to reply.

I don't think i want to evict for non payment of late fees. The tenant has paid 1st and last.

Rent was due for February on the 1st, but they also paid last month's rent when they signed the lease and moved in 6 months ago. they are late this month.

Do i have to wait until the "last month's rent" is due (that is, can the tenant has grounds to wait until next month to pay rent?) before i have grounds to serve them with a pay or vacate.

More confusing,  ?

Hello Everyone,

I'm here in WA state. Does anyone know if Landlord has a legal right to serve a pay or vacate on a tenant who is late on rent. Today is the 8th and rent is due on the 1st and a late fee is applied on the 6th.

My dilemma springs from the fact that the tenant is in a 2 year lease with 18 months remaining. I am in possession of last months rent. However rent is due every month on 1st as mentioned.

Do i have to wait until next month as they use up their "paid in advance" last month before serving a pay or vacate, or has the tenant broken one of the terms in the lease by not paying on time at the beginning of the month ?

I hope i am not being totally confusing in this post.

Thanks,

tony.
