I have an application, credit check, divorce decree for alamony, pay stubs, references from previous landlord. All of it, she acted as a model tenant until go time.

Thanks everyone. I appreciate the advice.  Im new at this. I have been researching this situation and haven't seen much on it.  If I just want her to quit the lease and do not want financial compensation do I still need bring her to court?

May 3rd a new tenant signed the lease to move in on 1 July. I did all my research in her, at least I thought I did. She had asked for an earlier move in date then the date on the lease if it was available. I let her know that if it was ready then ok. She was supposed to move in the first time June 13, still had not paid the security deposit. She had said on 3 previous occasions that she was going to deposit the funds. Nothing. Move in Day she was a no show, said her bank account was hacked. Ok. On the 1st of July I told her then, since I am out of state and drove down just for her. She begged me to allow a friend of mine to give her the keys and walk through as soon as she got her account squared. Still no $. I caved because she just "want a family home for my girls". Move in Day 2, June 24. Never showed up to get the keys. Said she was picking her mom up at the airport when she decided to finally text me 30 minutes after the meeting time. Three days before her actual move in Day of July 1st she finally responds to a text. Her dad has been in the hospital sick and she can't talk all the time. Says she still wants the house. I drive back to VA for move in Day. She says she will be a little late but she will be there. She still has not paid the deposit or First mo rent at this point. And I have addressed this repeatedly. Tells me her dad passed and asks me to wait. I wait Not once has she asked to reschedule. I waited all day for her to blow me off. I tried to be understanding but I just think she is full of it. I served her a notice to pay or quit via mail and email as a curtesy. What should I do now? She has not tried to communicate with me but this is the norm. I don't want her money or her a size a tenant. Advice?
