Listen buddy i totally disagree with you.  i never refused to pay rent and that's another issue.  I'm a stand up guy and I like to do the right thing.  Ive rented many spots and never had this issue plus I sure as he'll am not a sheep.  Landlord tenant laws are straightforward and I got my answers and I never lose.  Nice try self proclaiming club wolf pack but I'd say your the Mickey Mouse Club

hi I am a victim of a slumlord and I refused to pay rent on his terms in April for a dwelling unit and I can explain the details later.  He does qualify to opt out or VRLTA and I  am reviewing the lease agreement to see if he did and I don't think.these.are expressive opt outs

My notice was failure.to pay rent

1.  Take immediate legal action if failure to pay rent to evict the resident from the premises.

2.  Owner statement stating his rights from this agreement are cumulative in addition the law current or any future law.

3.  Default statement saying any breach false information will give the tenant the right to terminate lease evict the tenant and regain property without any specific time just in general.

Stating he will take legal action and he will have the right to perform actions stated in number three are nrights that he does has according to VRLTA because thats as specific as he explained it.on the lease therefore I don't think he made it clear that he is going to exercise his rights different to VRLTA so that is not an opt out even though he stated that his rights in the agreement are cummulative to the law.

i have been paying him.on time since August and except for the month of April I held back because he gave me an invalid 30 day notice. in VA a 30 day notice is 30 days from the rental due date not just 30 days from.whenever you choose and he ignored his false 30 day termination via email so if i were to pay the prorated amount i would have agreed to his terms and he is not accepting my rent and I have severe health issues and needed the time I was legally entitled to. He is a slumlord and I can't explain more at another time.

What I would REALLY like to know is the details I explained from my first message from those sections I typed from the lease consider him from expressively opting out of the VRLTA (VA landlord and tenant act) which gives me rights. Basically according to the law I am entitled to the rights of the VA landlord tenant act unless he expressively opts out and it does not seem to.me he that he did based off the information I provided however I would like your feedback

Hi I have a slumlord in the state of VA and I refused to pay him rent on April 6th. they considered it a dwelling unit and can qualify for opting out of VRLTA VA 225-55.01 if they expressively write it in the lease. I reviewed the lease and the first part states they will take immediate legal action for failure to pay rent. Then it has an owner statement that the rights given to the owner by the agreement are cumulative in addition to VA laws current or future any statement or promise won't be binding unless if it is in writing.

one other part is default stating any violation will give the right to evict the tenant and take possession of the residence(same process as VA law)

they stated they will take legal action, did claim rights on this agreement are cumulative to the law however

VA 225-55.01 does state you can opt out however and you have to expressively opt out of VRLTA

Im not starting off the lease by stating to take legal action if rent is not paid and stating the rights of this agreement are cumulative in addition to the law.

it is contradicting by saying any breach or violation of the contract in the default section will give her the right to terminate the contract evict and regain possession(does not specify any time frame)

To me this is not clearly expressively opting out of VRLTA because she still has those rights under that act by following the VRLTA process. To me it's not clear enough but I would like your professional opinion
