Thanks for your input everyone. I have decided to pass on the property but have certainly learned the importance of knowing your local zoning. And just for clarification, the property had a detached garage that I was planning on converting to an ADU, so that would fall into the new construction category.

Thanks for the response Mathew. Below is word for word from the Zoning code for the property:
"The owner of the property on which an accessory dwelling unit is located shall occupy either the primary or accessory dwelling unit. Prior to approval of an accessory dwelling unit, the owner shall record a covenant with Jefferson County stating that the owner agrees to restrict use of the primary and accessory dwelling units in compliance with this sub-section. The covenant shall run with the property."

I am looking to buy a property with an accessory dwelling unit but was informed by the zoning department that either the primary house or accessory unit would need to be occupied by the owner. This situation would be documented with an affidavit. Does anyone know anything about the enforcement in this situation? What would be the fines?

I am in the same place as you currently (looking for an owner occupied duplex in the Denver area) and came close to putting in my first offer this weekend. The numbers did not quite work to my liking but were close. I will let you know if I have any luck in the coming months. Good luck!
