UPDATE -

The tenant was able to get in touch with her caseworker. We were able to get the back rent corrected. She will not have to vacate the home. Thank you all for the advice.

Than you for your clarity. So you have never had to actually take section 8 to court for back rent.  My question is have you ever taken section 8 to court for back rent? Since you haven't then do you know anyone that has? I think after 10 months of trying to get through to someone at section 8 to resolve the issue is more than enough time. I'm now thinking that I will be forced to go to court to sue for the back rent due.

I have already verified. I think you all are missing the question here.

Your experience has been much different than ours. Now, the tenant is responsible for a portion of the rent even if they have section 8. Some of our tenants pay $50 and others pay $300. Could this be your issue?


 No she pays her portion on time. This is strictly section 8 not paying the $250 increase. 

That is exactly what they are doing. The tenant now has to get in touch with her case worker. They have until Friday to correct this or we are forced to serve a 60 day notice of non renewal on her lease. 

my PMC is in top of this. However I need answers or insight in has anyone ever sued Section 8 for back rent and were they successful? That was my question.

My property Manager has contacted the case Mgr, the supervisor, the person over that dept. I have the email train going back 10 months. They have called and spoke to someone who then transfer them to someone else and they have left so many voicemails. Now the tenant is reaching out to her case worker. This is absolutely ridiculous that no one has gotten back to them on this situation.

I have a tenant that is section 8. She has been a tenant for 10 years. Over the last 2 years we have been trying to get a rent increase from section 8 as taxes, insurance, and market values made have increased. We finally got the approval 10 months ago from section 8 to increase the rent from $1000 to $1250. However Section 8 has not paid the increase. Every month they continue to pay the previous amount. They are now in arrears $2500. My property mgmt company has tried every month to find out what is going on. They either do not get a response or they are given the run around. We are now having to involve the tenant as her lease is coming up and if we can't get the balance paid up to date then we are going to have to give her a 60 day non renewal letter.  Are we able to go after Section 8 for back rent owed? Has anyone ever been successful in this?
