My gardener went to remove a tree that was growing roots underneath the foundation, and when he sent me photos, there was cigarette butts all around the back patio and front of the house

How did you get photo evidence of them inside the home? I would not want to attempt eviction if the evidence was gathered in a manner that could be questioned. May need a physical inspection, which is ordinary course for many owners.
