Hello,
I'm looking for help. My abusive ex husband was awarded one of our properties. We leased that home out to Section 8. The rent payments once came to me and I paid the mortgage with that rent. He took the Mediation Agreement for our divorce to the section 8 office and submitted a new Form 1099 to the office that now has the rent payments coming to him. He is pocketing the rent payments and not paying the mortgage with those payments. Unfortunately, my name is still on the mortgage. I am trying to see two things. 1. How do I remove my name from the mortgage while we wait for the final divorce decree (if that's even possible)? 2. How do I protect myself from him sandbagging on the mortgage while I wait for the final divorce decree? I believe that the VA loan is in my name. I believe need a final divorce decree in order for him to assume the loan, but I don't think he will do that because he is am trying to finally abuse me. Thanks for any help.

Blake do you work in the field that takes care of the mortgage loan assumptions and removal of souses name from the loans? If so I may need to connect with you. I see your phone number listed in your response.

@Blake McWilliams could I do the assumption and the removal of my ex in my own? Or is it just better to use a lawyer? I wonder if I should just contact my lender and ask these questions, but without scaring them into thinking I won’t be able to pay the mortgage. I’ve been paying it on my own for 3 years, since the loan was started.

Hello,
In my divorce, I was awarded one of my martial properties. We have to assume the loans for the homes we each were awarded and remove the other spouse or refinance the loan. I do not want to refinance because of the high interest rates. If anyone has any experience with this, how can I remove my ex husband from this mortgage loan and still keep the loan terms the same by not refinancing it? I can afford the mortgage and have been paying the mortgage on my own since we bought the property. This imhomevwas purchased using my VA home loan for veterans. Also, I'm in Texas.

Hello,
I have a home that I lease out to tenants on section 8. They are set in a one year lease. However, the property taxes increases in my area and now the rent no longer covers the mortgage. I’ve asked the housing authority over my section 8 rebates if I could increase the rent and they said not until the renewal which is not until April 2025. I need to make up the difference somehow. Does anyone have any advice for this situation?
