thanks Michael. I'm going down there and will ask to see the applications and reports. I know 'stuff happens' but am doubtful about the bankruptcy. if they hem and haw about showing them then I know i must move everything. I thought moving 2 would maybe make them try harder but I think your right. its all or nothing.

I have an out-of-state PM and 2 on-going evictions, 1 for non-payment and 1 for non-payment and bankruptcy. Since turnovers are so expensive has anyone heard of a PM allowing an Owner to review a Rental Application and/or Credit Report and approve or not approve a tenant?? Would that be customary in Tennessee?? I think the bankruptcy might have been apparent on the Credit Report. If you would hire a new PM would you remove all your houses or just these 2 and remove any house that has an eviction in the future?? also the contract states that I must give 30 days notice and pay half the months rent.. Should i be required to pay for rent post-eviction?? Any experience with this situation??

you may get a decrease in rent. i just had a tenant move in. could have received $1330 fair market rent but sec 8 offered $1175. i don't see an advantage to sec 8 but tenant already in place. i have read where some areas are dropping rent to 80% fair market rent. economy is getting 'tight'. may or may not occur in your area. i'll drop sec8 at the end of the contract. i'm in the SF Bay area.

tenant moved in April. has certificate. paid 1st month. house passed inspection TWICE since May. have not received any rent from sec8 to date. nothing!! received ltr 7 July they 'propose' to terminate contract 4 Aug. can they do that?? will issue 3 Day Notice Monday if no rent received in mail. i believe i am victim of harassment due to ltr to HUD Regional Administrator in S.F. who never responded. time between inspections: 7days, 19days, 31days. sec8 offer is below FMR anyway. will answer any questions. won't rent to sec8 ever again. i'm done..

interest only loan expires in May. can continue to make payment on home and rental but not making money. both are upside-down. want to stay in house. will continue to pay until i get the feeling they are trying to 'stick' me' while we negotiate. then i will walk away. will not go any more negative with high interest rate. Question: how do i know they are foreclosing under CALIF law?? or can they just show up and evict? what are they required to do about notifying me? i understand they do not(?) need a court order. do they need the sheriff? do they have to notify me with time, etc? also will any payments after expiration of loan be 'principal only'??.. i am 74 and wife is 84...what are my rights?.. thanks..
