Yes, my state does require disclosure of material defects, even if they have been previously repaired. 

I feel I win, I have proof they paid to have foundation work done....completion letter and all.

First thank you for responding. 

During the Inspection some minor cracking in stem walls was observed from the crawl space, as were a few piers(post and pier ) noted that might need to be replaced in the future. I asked the Inspector if the foundation was ok, he said yes. 

I did not personally go under the home. 

I was satisfied with what the inspector told me, and what the disclosures stated(nothing about foundation work).  I purchased the home.

2 years down the road, I decide to sell the home. A potential buyer had an inspection done which called out much larger cracks and had a professional foundation company come in. Said company, upon arrival to do their Inspection says...." we worked on this house before".......

So I requested info from them, and wouldn't you know it....the seller I purchased from did in fact pay this company to work on the foundation, post/pier....leveling etc. All of which was not disclosed to me.

So said company provides a new repair estimate....which was almost identical to their original repair......hmmmm seems shady to me

Lost the sale, took the home off the market. Had another foundation specialist come in and survey the house and what repairs would be needed......$65k .....helical piles etc

As a note most of the evidence of the home shifting had been covered up in my opinion....stem wall exterior was slim coated hiding cracks. And the same inside the home now that I look closer. 

So I have been in litigation for 1 year, hoping for a result soon. I want the seller I purchased from to pay for repairs, legal fees, etc......better yet be made to buy the home back, and compensate for loss of value.

Purchased a home two years ago, had a home inspection. Inspector mentioned minor cracking in stem wall, nothing of major concern. Suggests having a foundation specialist look at if there is concern, which was not done. 

Sellers said nothing in disclosure about foundation issues or repairs/work done previously. 

Two years later, I put the house on the market. Potential buyers inspection reveals major foundation issues. Things have worsened since my purchase. I take the house off the market. 

Now I start digging for information, and request a foundation specialist to come to the home and provide an estimate. Just by chance, this company worked on the home for the seller I purchased from, oh really.

I obtain all documentation from this company, in regards to what the seller paid to have done. No permits were drawn for this structural work as required by california building code.

Further investigation of the foundation leads to $65,000 worth of work needed, with engineering required to be warranties for life. 

I.want the seller to pay for the repairs, since what they had done to the foundation was not disclosed. They have denied mediation, refused payment, and we are in litigation. 


I want to hear opinions and how you think this will end. Thanks in advance.
