Many lenders, like me, only lend to entities, like an LLC or self-directed IRA, on investment real estate. If you've already created an LLC for this purpose, you are already one step ahead of other investors!

If you can qualify at a bank with the income, credit and time to qualify, then you should always choose that route.  If you don't have the income, credit or time to work with a bank, then you should look at private (family) money.  If not available, then approach a hard money lender like my company.

To give the really short answer, probably 12%, if it is an asset based loan (not looking at your credit or your income).  Most private lenders that offer a lower rate, make up the difference in fees and you still pay about 12%.  After lending over $200 million this way and selling those loans as mortgage notes, this is what I've found is the happy medium for borrower and investor.

I would make sure the litigation is cleared up before structuring an offer.  A lis pendis lien will probably stop the deal anyway.  Without knowing more about it, that would be my advice.
