One man's trash is another man's treasure.

In my opinion, banks are still holding on to some toxic assets. They're also at the same time streamlining and tweeking their foreclosure, short sale and mitigation processes. They seem to be waiting for all the hoopla and the witch hunt against predatory lending to fade away. When it does, I believe they are going to rip off the band aids and cause one of the greatest opportunities for cash investors since the mid 80's.

Starting to see some daylight!

My area has taken between a 5 - 9% drop in value based on 2011 assessment. The Houston, Tx. market (in my opinion), is positioned to be one of the first markets to rebound.

My view is that it takes three main ingredients for a vital market: Plenty of inventory, qualified buyers, and access to cash. There appears to be a growing migration to Houston and it's surrounding areas attracting a wide range of mattress money clients. Also, owners are obtaining better rates of return on low risk owner financed transactions than available in other instruments.

Personally, I prefer single family residential. My question is always, "How fast can I sell it, Hopefully at a profit if need be?" I also highly recommend looking for transactions that meet the 50% rule. The current market is still staggering....lol.

In my opinion, Tim doesn't have a leg to stand on should Bob decide not to pay. Things to consider: Is there a protection period in the last listing agreement? If so, how long?

My other concern would be Tim's honesty. With him presenting the offer, will he try to claim procuring cause to the transaction.

The best way to negotiate on this transaction would be to get with the buyer's agent directly and tell him that he won't sell unless the price is increased to (x) or the agent's commission is reduced. I would tell this new buyers agent that I don't have a listing agreement with Tim and don't want him participant to the transaction. I'd also tell him that if he wants the transaction to close there will only be one commission and that he will need to work as intermediary.

Like one of the previous poster, anywhere you go waving money, you can find someone who will do business with you.

I recommend that you do the work yourself. Research areas. Interview agents who can give you information that allows you to make intelligent decisions.
