Great sounds good just want to do my homework before calling or contacting anyone so I'm better equipped to deal with the situation. Knowledge is power!

Thank you Sue Kelly - If the tenant was bound by a lease wouldn't the section 8 go along with whatever lease they were on until the end of the term unless landlord agrees to let them off (ie by filling the apartment with someone else)? It seems they didn't get in touch with the housing authority about moving since I agree I don't think section 8 would pay for more than 1 apartment at a time.

Hi guys thank you for the response. So for example if the tenant moved out on 4/1 and they had a 1 year lease until 6/30, for the month of April, May and June would I still have a right to collect the Section 8 portion of the rent as long as the unit has been vacant and I've been making efforts to getting it up to shape and also advertising to rent it out?
Also for the month of July we just received another check which is why I was a bit puzzled. It sounds like they either did not contact Section 8 to let them know they moved or some kind of updating issue. Would they contact me to refund any or all portions of that?

Hi, this is my first post on the forum, really appreciate some advice on this:
We don't normally rent to Section 8 tenant (so we are inexperienced in this). We had a Section 8 tenant break the lease (3 month before their 1 year lease term was up). We continued to receive their Section 8 rent portion for the following 3 month and now we are in the 4th month and we still got another check. Here are a few questions:
1) Is this just a glitch in their system/or it takes them some time to update their system?
2) Does this happen often or anyone else experience this?
3) If we deposit this check could the State ask for it back?
4) What is the normal procedure for this, do we need to contact the State or will correct itself?
5) The tenant did not pay for their portion of the rent after they broke the lease so we had thought about using this extra check to reduce some of the outstanding amount for them, not sure if this is a good idea (there is zero communication from the tenant for the past 2 month).
Thank you,
~David
