Kimberly, Action overcomes all obstacles. Clearly you want to take the right action. I would defiantly agree with James Galla to get with an attorney, just to pick their brain on best practices and approaches 

 In addition, it will give you the confidence that what you are doing if you do it right, is well within legal perimeters. Allot of noise out there. People telling you that Wholesaling is not legal. It is as long as you do it right. There are allot of people to help doing this business and allot of money to be made. Feel free to reach out if I can be of any help to you. I run a Wholesale company out of Texas.
