We received some heavy rainfall this past winter, and now I have leakage around my chimney.  I anticipate that it could cost $5000 to fix and I'm questioning whether to take the insurance claim (deductible is $2500).  I expect my insurance company to just turn around and raise my premiums,

to recoup this loss - even though I have never filed a claim in the 16 years I've owned this house.  So my question is :

Is it worth filing a claim ?   Thanks !  Dave

I contested the denial because they did NO due diligence (they asked a landscaper what happened and got a "it just broke" response). I asked for a neutral 3rd party adjuster to find out the cause. The whole scenario makes me nervous because my house sits about 15 feet lower than the neighbor's pool and irrigation water system. If anything ever broke it would flood my house with thousands of gallons. I see the irrigation system routinely leaking into the street - a small stream. last resort, insurance commissioner.

the vapor barrier in my crawlspace has been shifted and is no longer completely covering the floor. Plastic must be replaced. a nasty job in a very tight crawlspace.

my neighbor's irrigation broke and over the course of 5 hours dumped into my backyard and crawlspace under my house.

damages to my crawlspace amount to $2200; my deductible is $2500.

I filed against my neighbor's insurance (Farmers) and their finding is that they are not legally liable for damages - no one was at fault.

I will ask, but don't expect to get damage costs covered by my neighbor.

$2200 doesn't seem like enough to get an attorney involved.

Seems my last (and only) option is Small Claims court - is this even a worthwhile option to take ?

neighbor's irrigation broke and flooded my basement.

I could claim against his insurance, or my own insurance which would "subrogate" a claim against his insurance.

damage is about $2500 to clean up. my deductible is $2500. It is unknown whether claiming against my home insurance policy will result in a rate increase. any feedback ?

If I claim against my neighbor's insurance, they will try to lay the blame on the landscaping company that maintains the irrigation system. So the question of who's liable is still in discovery.
