in case anyone wants to know the outcome of my nightmare tenants here it is: I offered them their security deposit and $1000 and they agreed to leave by the 1st. Done deal. Happy ending. I feel much better now.

I was really leaning toward the nephew in the RV solution

ok, I guess I wasn't really clear on what's going on in Nevada. I do really appreciate each one of you giving me ideas and advice.

Yes, they are being charged a late fee, supposedly, per their lease however my PM has chosen to not collect it one month and these last 2 months I don't know what he's doing. As soon as these last repairs are fixed he's out.

As for the repairs, they are things like the sprinklers breaking in the back yard, the electrical is wierd on the swamp cooler, there's a leak in the roof - things that the tenant probably didn't cause or is responsible for but it's just strange that in 3 years I had absolutely no problem and they've had problems since day 1 - hence having to foot the bill myself.

Now to the topic of how to evict them: They have 5 judicial days, after the first eviction paper filed, to come up with rent or I can go in with a sheriff and remove them. They have successfully come up with the rent one day before that last judicial day making the eviction void. My original question was how can get these people out? I'm interested in beachbum's "other than non-payment" idea but not sure what that would be. Minna: I guess my first post sounded newbie-ish but no this is not my first rental, just my first bad tenant and my first bad prop mgr. Just trying to find a way out of this nightmare. Thanks again for all the help!

Still would like to know what "buying someone out of their lease" means. I'm thinking letting them know that I'm not renewing the lease will just make them care even less about paying the rent and causing damage on a monthly basis. Not sure what you'll think I'll know better with the next tenant except not to have one at all. Thanks for the input though.

thanks for the input amaris. If I have tenants in the future I think I'll use that tactic. A little late for these guys. I don't want to give them a prize for the doing the agreed upon, responsible, adult thing like paying their rent.

I believe my property mgr is collecting late fees but not sure since he seems to think he doesn't have to communicate with me about what's going on down there. I'm thinking it's a sexist thing but not real sure what his problem is. Anyway, he won't be working for me much longer.

To buy them out of their lease would I have to pay them the monthly rent for their remainder of the lease? How does that work?

I own a house in Reno, Nevada and I currently have tenants living there. They have a 1 year lease that's up on June 30th, 2008. Since they have moved in they have complained about one thing or another. There have been maintenance issues every month. To the point that their rent doesn't cover the mortgage but goes straight to the maintenance issues every month. To be honest, most of the issues are valid but there are some that I know they've caused themselves. Anyway, I have diligently fixed every issue every month. Please note that I lived there for 3 years before they moved in and I never had any of these problems - it's a mystery to me. Now they are starting to not pay their rent on time. This is the 3rd month that they have been late on their rent. This month I got their rent on the 14th. Every month my property mgr has filed the eviction forms and every month they come up with the rent eventually. Here is my question: Is there any way I can get rid of these tenants? This has been a nightmare and is just continuing to get worse and worse. I would like to find a way to evict them or make a deal with them or something. Can you help me?
