Hi,

I just submitted a Lease Renewal (month-to-month) or Notice to Vacate to my current tenant. The day after I mailed the form I got an update from my realtor that he is advising that we take the property off the market until her lease is up (10/31). He is having a very hard time showing the property (she cancels all the time and only had a 30 min window a few times a week that she is available for him to show the property). Of course, if I had known that, I wouldn't have offered the month-to-month option. I got news today that I have a potential buyer. She needs to sell her current home before she buys mine and would like to rent the property beginning Nov 1 while she sells her home and until we close escrow (it's a short sell, so it could take some time). This is really the best case scenario and I would be thrilled if it worked out.

My questions is... can I retract the month-to-month lease renewal option. I want her lease to expire Oct 31 no matter what. If the potential buyer doesn’t pan out I still need the property vacant so I can sell the place. I mailed it on Thursday, so she just got it. My condo is in CA. Thanks in advance for any info. I really appreciate it!

My question involves landlord-tenant law in the State of: CA

Hi,

My current tenants lease is expiring soon. She has shown interest in going to a month-to-lease agreement. This actually works very well for me because the condo is on the market and gives me flexibility. The current lease agreement reads:

Ending or Renewing the Lease Agreement. At the end of the Lease term, this
Lease Agreement shall automatically continue for an additional Lease term until such
time Landlord and/or Tenant provide a written notice of 60 (sixty) days prior to the end
of the Lease Agreement or Lease renewal period.

How to I handle this communication? Do I send a letter indicating that if renewal is desired it will be month-to-month and enclose the new contract? Does anyone have a sample letter of what this would look like?

Hi,
I am currently in the process of selling my rental unit in CA. I have a buyer and we are expecting to close escrow at the end of October. Fortunately, my current tenants lease expires October 31st. We really lucked out with the timing. Yesterday, she contacted me to request to break her lease a month early (move out Sept 30th). In the past when we had a tenant break a lease it hasn't been a problem. They helped to find a new tenant and the property didn't go un-rented for even a day. Of course it doesn't make sense to do that this time. My initial response was to just tell her no. She can move out whenever she wants, but she owns me rent until Oct 30th. Is there something I'm not considering or is this the proper response?
