An Order Determining Homestead Status of Real Property in Florida is the order that releases the property from probate and effectively puts it in the names of the heirs. No subsequent deed required.

@Montray Wilson: You'll definitely need to find the heirs. And if neither decedent had a Will, you'll need to locate the descendants of any deceased heirs as well. Essentially, anyone and everyone you can locate. I always suggest compiling  an heir list that includes information on date of death, evidence of any probate for the estates of the heirs, etc. It's not an easy task if the family is large but focus on descendants for now (rather than siblings or ancestors of the decedent).

Actually, I've probated estates of non-residents prior to the "home probate administrations" ever getting off the ground. Either way, you'll need both administrations completed at some point. Good luck!

Real estate in Florida will likely require a probate administration in Florida, regardless of the decedent's home state/country. Feel free to contact me directly if you'd like to chat about it.

Sorry for the delay folks - I didn't see that there were any responses!

I practice Probate, Trusts and Guardianship law primarily. Much of my work is handling probate caes throughout the State. (Geographic proximity is irrelevant in uncontested probate cases since the State turned to electronic filing.)

Hi everyone, thought I'd introduce myself. My name is Long and I'm a Florida Probate attorney. I've practiced almost exclusively in probate, estates, trusts and guardianship for the better part of my career.
