My property is in the Dallas Metroplex and everyone knows how the soil and foundations are a problem to begin with.
If a tenant is responsible for keeping the lawn watered and the irrigation clock was turned off every time I checked it.
(They also complained that it used too much water.) I told them numerous times they needed to not tamper with the clock and they have denied tampering with it. Now that they have moved, I have a crack in the patio. Can I hold them liable for the repairs.

OK, Dumb question. Does Texas require a rent increase notice on a lease? Not month to month but a 12 month lease?
I would think if you have a good tenant you wouldn't want to spring it on them the last day of the lease either.

Any thoughts?

I have to apologize to everyone for not responding to your emails. Looks like it's pretty much unanimous. I appreciate the answers you gave me.
As it turns out my tenants decided to move in the first of June and they turned out to be up front so far. I believe it was an issue with the notice. I talked with the apartments they were at and they told me they were only 10 days short and let them out of it.

Again, thank you for the valuable advice. And sorry again for not paying attention to this post.

Consensus question.

I normally prefer to start the lease on the first. (note's is due the first). My tenant wants to move in the 14th. Do many landlords sign a mid month lease or is it better to collect a prorated 15 days + First Month + Security and start the lease on the 1st of the following month?

Something fishy going on. We found out later that the tenant in the other unit actually owned the duplex. He sold it to the person my girlfriend bought it from and that person sold it to her before title changed.
In the meantime this guy (according to the tenants) threatened to kick them out if they didn't sign a new lease, harass them etc. Thats why they want out but why wait until now?? Now all this crap surfaces.

I would think she has a possible suit against the seller, his agent, possibly the previous mgt co and the tenants. She has made an appointment with a lawyer Monday.

Just getting ugly. So the question is I can't even take care of her property in texas? She's in California and moving out in a month. So far every mgt co that she has contacted has not made her very comfortable. All the contracts seem to be designed to pilfer every bit of profit from the owner.

OK, This is getting better by the minute!!

We never got the original lease. We were told we would but never did because no one really knew. Alright our bad, should have walked.
The tenant that moved out told me that a lawyer told him that there was no lease because the lease was not signed by the landlord that the previous mgt co. had the original. When we called the company, the owner was very rude and said he wasn't getting into it and too bad for us. (god I wish I could name names) can I??

So we agreed to let them out of the lease but they would forfeit the deposit (three months left anyway) and all agree. We can live with that. I asked both tenants to email us a 30 day notice and the one who has moved did and I am waiting to get the other tomorrow.

Now the plot thickens:
I get a call from a lawyer (I assume) stating he was a broker and asked if I was a licensed broker in Texas and I replied no. He then asked if I was managing property in Richardson and I said its nunyabusiness.
Can't be sure, but just know that little RAT ^&#&)$^# called a lawyer but why?

So does a boyfriend need to be licensed in TX to take care of his girlfriend's property??

BTW if y'all want to know names so you know who to avoid, be glad to share.
