Thank you for the quick replies,  I’m sorry I wasn’t completely clear. By landlord I mean the leasing company and they told me that another roommate is the deposit holder and said that they wouldn’t give any money back until the holder leaves (he’s not resigning again, which would be this coming May).  So I should get it back then. I’m just worried if something happens and I don’t even live there anymore, not to mention the principle of it. I sent an email to the leasing company that I would not be resigning and they confirmed. Is that enough to avoid potential detriment to me?

So I moved in with a couple friends back in July. We went three ways on the security deposit ($300 a piece) and signed a six month lease. I didn’t resign but the other two did and someone new took my place. I didn’t bail on the lease and gave our landlord plenty of notice.  Now I asked for my security deposit back and they tell me because one of the other roommates is the security deposit holder I need to get it from him. Me and him agreed that the new roommate should pay me and take over the security deposit. It’s been over a month now and I honestly don’t think he’s going to pay me. What are my options here? Small claims court? Or should the leasing company have to give it back? Maybe There’s some information someone can share that’d be helpful. Thanks in advance.
