Drew/ Jeff, My spouse has non-passive income that we could use losses to offset as a real estate professional. 

I have 4 rental properties and am also an officer of the Homeowners Association that these same rental properties are a part of. As the Secretary/Treasurer, I deal directly in the day to day management of the HOA, including paying bills, collecting dues, securing contractors, insurance, coordination of common ground maintenance, answering owner questions and concerns, etc. In regards to the 750 hours needed to qualify for Real Estate Professional status (for tax purposes), can I include the hours spent managing the HOA, in addition to the hours I spend managing my own personally owned rental properties? 

I have no outside property management company for either the HOA or my personal rentals properties, and I do not have another job. So I meet the 50% requirement, and also meet the material participation requirement (500 hours) due to time spent on my 4 owned properties.

Also, do I have to have a 5% ownership stake in anything I include in the 750 hours? The HOA is not something that is owned, but I guess I do own 4 of 38 properties in the HOA, which is more that 5% (if that counts!).
