The proper time would be to file for an ejection. This should be a quick and simple matter depending on if you are seeking to collect the past due rent.

Great situation to be in.
Rent out the brooklyn home then sell it after 3 years (unless you need cash now)
Renovate the vacant home then rent it out to collect cashflow
Move in with your mother, and rent out the current home you live in for more cash flow. After 2 years you should refinance it, once you do that you and your mother should move and you should rent out that home.
After 3 years, you will have 3 homes that cashflow, a nice chunk of change from the sell of the property and you and your mother can live comfortably in nicer place

One thing to consider is refinancing your current home before purchasing your new one. If you air bnb the home you will be able to pay of the mortgage and cash flow. Now you are buying your next property already having a cash flowing asset and tons of savings

I would 100% file as an LLC. Outside of protection to me the biggest thing it does it helps you enter the mind of a legit business owner. You properties are businesses and should be ran as such and this includes having an LLC. The cost is minimal
