One last question involving interest rates. If you win the auction with for example a 12% interest rate, is there a grace period for the person redeeming the property before they have to pay you interest?

If no-one responds to the foreclosure suit, what are the chances a court would assign a guardian ad litem for the case?

In my opinion and I'm not a judge, but if an individual has paid taxes on a property for 4 years, that's sufficient time for anybody to redeem a property, I would see no need for a guardian ad litem. 

@Denise Evans so is the new amendment relevant to any tax liens that have not be eligible for foreclosure as of 10/1/2024 or liens purchases after this date? 

And just to clarify, the new law gives someone with redemption rights, the opportunity to demand the judge hold a public auction, but would require them to hire legal counsel to do this? 

If auction is not demanded and no response is made from anybody with redemption rights, the deed will be issued and title quieted correct?

And this moved the foreclosure from 3 years of the date of the sale to 4 years now? Do you think eventually this time will be shortened?

@Denise Evans Can you send a link to your video? And do you have rights to improvements required by state or local municipalities for reimbursement if redeemed?  

@Denise Evans do you have possession rights with the new tax lien auction? I have tried to find information on possession rights with this, but can only find information regarding the old tax sale auctions. My county just swapped to the new tax lien sale.

@Denise Evans if a tax deed is purchased from the state inventory list and the tax auction was from more than 10 years ago. If you receive the tax deed, does the redeeming party have to pay 10 years worth of taxes and interest to you if they want to redeem the property or is it different when purchased from state inventory?

@Denise Evans I spoke with the tax assessors office today in reference to overbid. They stated after the 3 years when a tax deed is issued, if the owner tries to redeem the property it will be through me so the overbid will need to be added to the cost for the redeeming party to pay me. Is this correct? My understanding was it was kept in a separate account by the county to pay if the property was ever redeemed?

@Denise Evans okay thank you for all of your help I am just starting out with tax sale and the property I’m interested in my family use to own as years ago but the owner has passed away so I know the sale will be void so I won’t touch it till the tax deed is issued. I also watched your video on taking possession of property it was very helpful!

@Denise Evans when taking possession of a property after either the tax sale or after the tax deed, if the property or structure is vacant and not abandoned because abandonment is hard to prove, do you have to give written demand for possession or can you go on the property and just start using it for rental or income property? Thanks

So if there are heirs to the property it would be best to wait until a tax deed is issued and then take possession of the property after that? Would you need to send a notice to all the heirs to demand possession of the property after the tax deed is issued to take possession of that property?
