what we decided to do is tell them they would both have to vacate the building before closing & told them they could pick the closing date. They didn't want to move & she took the building off the market. We received our earnest money back...& moved on.

I'm new to BP and have learned so much. I'm so glad there is a website like this. Here's my dilemma. My husband and I have recently bought a 4 unit apartment building in Indiana. The seller is an elderly woman (85) who has lived there for 40 + years. She wanted to stay as a tenant and we have agreed to that. We have negotiated her rent but she has a lot of stuff throughout the property. We plan on dealing with that within the first 30 days. Her son lives in one of the other apartments. He has no lease (that we know of) and pays his no rent. His apartment is in horrible condition from neglect and abuse. We would not want tenants like him. He doesn't have a lease. We need him out to do the necessary repairs, including leaking sink poppies and tiles missing in the shower and wall exposed and getting wet. we plan on rehabbing the entire building also. What steps do we need to take to legally evict him when we take position next week? Thanks
