Wayne, I am not leaving out details but unfortunately the RE agent is very unethical at this point. She keeps on changing the story, first 1500 for seller to move, later 1500for HOA, do not know what is next. We were not interested if the property had HOA dues that would be passed on to us but the agent assured us and said she will split the dues with seller.

Wayne - they got 3K relo money that they are putting towards deficient HOA (seller had not paid HOA for 2 years), after negotiations HOA due is $6K, to be split between seller and agent. Seller is paying 3K, agent is telling us NOW that she will pay $1500 and other $1500 is to be paid by us. The deficiency waiver protects the seller not the buyer - right?

Wayne - yes this is coming from the agent and we all have signed arms length affidavit, will check to see if there is mention of side deals. It is Fannie. the request is not in writing.

We bought a short sale property and are in escrow - 7 days away from closing. The sellers are asking for $1500 to move out else they will void the deal - can the sellers do that? Buyers in escrow are not at all protected?? and advise on how to proceed and what I should be aware of as a buyer in this situation?
