Hi

If you have any reliable and responsive property management to recommend for Rochester, NY area, appreciate it if you can let me know. Would prefer if the PM is willing to communicate using whatsapp or Skype etc beside email as I am an out of country investor. I am wiling to accommodate to the different timezone to communicate with this PM. Thank you very much.

I just got a reply from PM. He said that the tenant has some proof with the previous PM company that states we are suppose to complete repairs. However I had never signed or saw such documents before. PM said tenant threatened to sue us. PM kept encouraging us not to evict as we might lose. 

May I know is it that hard to do a physical deposit at the ATM in the bank? PM kept sending us small amount as trial tranfers but we had never received any as of now. I had requested him to go to the nearest bank for him and phyiscally deposit the rent. 

I now request for immediate eviction and all documents proof (receipts and photos, which till now I have not receive).

Would like to hear from experts here if there is indeed something fishy about this PM or is it just a bad tenant? For the record, I am an out of country investor (sorry if I misconstructed in my early post). Thank you.

I had asked my attorney and he said that I have the right to sue the tenant for unpaid rent or to evict the tenant based on unpaid rent. Depending on what the issue is with the property, however, the judge may rule in favor of the tenant. Tenants are allowed to withhold rent if the condition of the property is uninhabitable. Therefore, it depends on what the condition of the property was.

We have requested for the PM to evict the tenants, photo proof of the remodeling and receipts. The remodeling was flooring @Patti Robertson

I am not sure if they are on Section 8 or not. But is it logical for a tenant to remodel the house given their financial status? I had not arrange any City inspectors to check the house as the Certificate of Occupancy is not up yet.

Thanks Deanna. I am trying to talk to a few PMs, but not sure if I am just jumping from one hole into another hole. Seems like engaging a PM as an out of state investor, is like taking a blind leap of faith.

Hi

My PM just told me that the tenant has made some renovation with my property without my consent or informing them (I am an out of state investor). Now PM claims they refuse to pay the rent as they had been complaining about this issue for the past years already (for the record, I just change PM few months ago). My questions:

1) tenants are not allow to do remodel any part of the property right. If so, I do not want to pay for this remodeling which I was not aware or inform of. Am I allow to do that?

2) the tenants I have are not high incomers, at most maybe middle incomers with some needing help on Section 8. This is why I find it funny that given their financial background, they can still offer to pay for the remodeling?

3) with regard to no 2, it leads me to suspect PM is not being truthful. Since she has taken over few months ago, there were constant repairs and I could break even (only) slightly for 1 property. PM kept telling me its the ex-PM negligence. But when the realtor went to look at one of the property, he mentioned that 1 part of the room needs serious touching up. Which I find weird, because if PM has been claiming repairs all these while, why does that particular area of the house still needs touching up? So far PM has only given some receipts as he claims that all items are purchased in bulk so not easy to get the receipts. And out of all the monthly reports, 2 have glaring errors which I need to clarify.

4) PM claims that tenant will bring up to the city authority and refuses to pay rent. We will have to go without rent for 4mths till he moves out in Nov/Dec (when he finalized his financial stuff with his new home). PM is not keen to evict due to cost and other issues (e.g city authority etc). We have requested PM to do an eviction ASAP

5) are courts usually tenant friendly?


Appreciate it if fellow investors here could advise me if there is something unusual about this whole fiasco, especially my PM? I try not to change PM as I am not sure if the next one is good or not. But if something is really wrong, I guess I have to search again. Thank you
