How long would you give a tenant to respond to your text message about renewing and inspection of the property?

They sent us a check for Feb and also for March.

The strange thing is he will not answer my text message about signing a new lease and allowing us to inspection our property prior to signing a new lease. 

Can we enter the property if he does not agree for us to inspect our home?

I have an rental property in near Memphis TN. The tenants lease expired January 18th, 2024.

I sent him a text message on January 30th, 2024 and ask him if he wants to sign another year lease, or sign a addendum lease and go month to month. 

The tenant will not answer my text message.

I also explained to him in the same text that we have to come to our property and complete an inspection before we can move forward for him to sign a new lease. 

what should I do?

How much notice are we required by law to give him notice for us to inspection our property?

He still is living in our home.

File a consumer fraud case with your state attorney general. 

It is online and free. They will follow up. 

Oh, and remember, real estate used car salesmen/women, err “agents” always lie.  At least in my experience. 

When we file a consumer case fraud with the state Attorney General is this against the tenants and property manager? I will tomorrow.  Thank you. I had no idea I could do that. I filed a report against the property manager with the BBB and TREC.

I’m sorry you are going through this. In most states, the laws and landlord rights are evident.

I would see if the guidelines, case law, and relevant laws are easily accessible online or if the local governing body can point you in the right direction.

Many states have tight timelines and guidelines on the reports owners are required to provide to tenants if they want to keep their security deposit.

The legal recourse with the property manager is much more nuanced. I would try to establish if the juice is worth the squeeze before you take any legal action. Then I would collect all the facts and clearly lay out your material damages before you consult an attorney.

One word of advice… get heads on beds, I.e., fix up your unit and re-rent asap!

How long do we have to get this figured out? Tenants are demanding their $1,400 deposit returned.  We are trying to figure out what to do. We have called 3 attorneys and none of them will call us back. The PM stated he gave the tenants they were not getting their deposit back, but again PM could be lying.
