I am able to terminate the contract without owing anything with 30 days notice. I gave her notice today.

She charged me for renewing a lease (for a different property) 29 days prior to this lease even ending.  I am assuming she did that because she figured I would not respond well to her refusing to work with me after all their mess-ups.

Hello,

The management company I have been using for a few years has been not so great. Something happened recently which led to me canceling their services very recently.  My area was affected by Hurricane Ian. We had a lot of people coming in to do repairs after the hurricane. The management company provided me with 2 options for tenants and I chose the one that seemed ok- they provided me with information that they had a clean background check and made 3x the rent. Well the tenant moved in January 2023 and stopped paying rent in May 2023. I had to evict them and the eviction was finalized end of June. Afterwards I found out they were working on construction/ self employed/ 2 men from out of state and area. If I had this kind of information, I would have never accepted them.  On of the agents from the management company said she would have given back the placement fee because she knew the circumstances with the tenants seemed off. I asked the management company to waive the placement fee to find a new tenant given the circumstances and she said she could waive her fee but not the one who found the tenant.  Once I entered the home- the AC was set to 65 degrees. I found out that although the tenants had been helped to fill out the electric bill, they had not paid the deposit so it was never changed from my name. My AC bill was +1000.  I had my account on auto pay and hadn't realized the situation until after they moved out. The management company acknowledged they screwed up and she offered me to reduce the management fee by half moving forward but I said I'd rather manage it myself  and I did. 

The management company was still/ is still managing 3 other rentals for me. I saw the management company waived the management fee for May 2023 on the evicted house but recently I saw she charged me the management fee for June 2023. She said that it was legally within her right to charge it.

On one of the other rentals they were managing- the lease ends at the end of October. I noticed that she charged me the renewal fee 500+ dollars for this home- even before the lease ended. 

I gave her notice today about ending the management contract but I am obviously not happy. There have been several other issues with this company. I wasn't sure beyond firing them, if there's anything else I can do. I am not happy that she charged a renewal fee for the lease even before this lease ended.

The tenant signed the lease and sent it back. I will not be a push over in the future, and I am glad I don't need to worry about evictions etc. Thank you

The market where I live  is slow. I just finished evicting a tenant because of non payment- it took almost a month for the eviction to finalize. It took another month for me to find a tenant to move it. I would like to avoid eviction if I can. I will raise the rent  closer to market value the next time renewal comes up, or sooner if the tenant doesn't sign this lease on Friday.

Thank you, everyone, for the input.

The rent is at least 500$ a month below market value, I'm pretty sure they want to stay. The old lease ended 6/30/23, so now they are month to month. They pay rent on time and have been ok overall x 5 years. The last time I did the walk through- in the last month- they had installed things that they didn't ask permission for- I told them to remove it. and the AC coil was very dirty, so we had a conversation about that. I think they tenant is acting like a child because she's not happy.

I originally sent the lease on 7/17. I reached out to  the tenant on 7/23 and again on 7/25. I asked her to get it to me by Friday 7/28 and she said she would.

If she doesn't send it Friday then I can deal with her then. I was thinking I would tell her if she doesn't sign by Friday then don't worry about the lease and it will be month to month and I will explain what that means. and Then I can go from there?

I provided the tenant with a lease over 9 days ago and have reached out twice since  then asking about them signing it. If the tenant is unwilling to sign the lease in FL- does that mean we are on a month-to-month basis?

I think the tenant is upset I put my foot down about a few items after the walk through- including removing items they installed without asking in the home- so I think the tenant is trying to be passive agressive. But I just wanted to know what the implications are. thanks

Thanks for explaining that!

THe evicted tenants came from another state and returned there when they left so I don't think small claims court would be helpful since they don't live in the area.

If a tenant is evicted, is that the equivalent of getting a judgment in order to pursue them in collections? I just want to make sure I understand how this works. Thanks


I spoke with the attorney who prepared the lease and did the eviction- he stated that I can charge for July rent (to evicted tenants)- their lease didn't legally end till 1/24- or until the unit is rerented. I expect to have a new tenant in August. I wasn't sure if anyone else has done this?

Just to clarify- the eviction was finalized at the end of June. But the attorney said I can charge evicted tenants for July rent- until unit is re-rented. which I expect to happen in august.
