If you want to toss everything left into a dumpster before you have legal confirmation of him completely vacating the unit and confirmation that you can trash everything left behind, make sure you catalog it well. You're going to be on the hook for reimbursing the tenant for all you tossed. There are legal requirements for disposing personal property left behind by a tenant. I think it is trash and assume the tenant doesn't want it, does not meet that legal requirement. Without the tenant explicitly stating (preferably in writing) you can trash whatever is left, you likely have a requirement to store items left behind. 

He may leave all the unwanted items and never pay you. That is what the security deposit is for and if need be, the small claims court system.


 Maybe I should have clarified, like I said I posted on here before about this tenant, they both lived there husband left months ago just her there, he left all his stuff, she left most of her stuff, my 14 day notice I gave her ended on 31st of Jan, she told me she was out, husband wants to get stuff and throw out /clean out what's there that's why the dumpster, I just want to know if I can change locks or should I leave it till they remove there stuff, I was going to post a 15 day get your belongings out or I will disgard notice on the door. Nys is a joke 

Right but can I legally change the locks,? Her husband is on lease still, if I give him x days couldn't he just go take all valuables in that time frame it just sucks because I can't separate them from the apartment because apartment is full of stuff, basement is filled and garage is filled, like I said he is having a dumpster dropped off Tuesday,, so I'll have to allow access 

Hi I posted in the past about this tenant, but anyway no payment for January gave 14 day pay or quit in mid January, she said she left but left some of her stuff, her husband called me (they are getting divorced), said he has alot of stuff in basement, boy he wasn't kidding place is filled w garbage and stuff worth money all their personal stuff, what do i do? He said he rented a dumpster for this Tuesday but like I said no rent for January and now we are into February, can I change the locks, I want the stuff gone but in a bad situation, he said he will pay me January rent when he gets money, but I'd hate for them to go and take all the valuable stuff and not pay me and leave me the mess, I probably can't hold their stuff hostage, thoughts? 

Thank you I appreciate all your responses, yea I'm kinda leaning towards telling her he can't stay and telling her I'm not renewing her M2M lease, unfortunately in Nys if the tenant has lived there for 2+years they get 90 days notice, does this sound feasible? Since unless there is non payment an eviction will be tough, either way I want them both out 

Hi first post here just looking for advice, I rent a multi family home 2 unit for about 15 years have been lucky to have both units rented for 10 years no issues, well until now. The tenants in back apartment were married, was informed by the female that they were getting a divorce but she would be fine paying rent alone. OK. A week ago I received a shelter verification form from DSS for a male individual who I don't know at my apartment. I contacted the female renter and asked what was going on and she said he was living there, my lease like most leases states tenant must inform me if someone else wants to move in and cannot sublet, I always keep all my rental agreements in one spot and I don't have hers so now what do I do? I'm sensing this new guy will be trouble, should I allow him to go on new lease or evict both, I'm so mad I can't find our agreement anywhere, let me know, thank you for your time
