Thank you Mark-- I agree. We need to be able to complete work. I understand it is problematic for her particular lifestyle, but she is not the owner and is not directing the course of action here. Im trying to find a balance between being a good person and making a good business decision...not always easy.

thank you for the thoughful responses. Im not from the South, but just hear that they "shut down" for most of November and December for holidays-- not trying to label any paritcular part of the country in any way. It is likley weather related as well-- too cold :)

She is not paying market value and we will definitely rent it for more once she leaves in late January. Just dont want to have issues getting it rented over the holidays-- its a "risk" we do need to consider though. 

Regardless-- yes, I dont feel repsonsible for her dog issue at all.

thanks for the comment! True, would love to have her out a bit sooner. The triplex is in peachtree hills/buckhead area of Atlanta. I definitely considered having her leave early and then renting for more (even before this project came on the radar), but from what I hear about areas in the South (Im live in California), not a lot happens over the holidays; people dont tend to move, etc. I was foreseeing us sitting on a property unrented for 2+months if that were the case. I don't know this to be true, just speculating.

I understand your point- However, Her barking dog is the issue, which is very much her repsonsiblity.

Im also trying to learn from this situation for issues in the future as well.

We purschsed a triplex with an existing tenant in one of the homes. Her lease ends in Late January. We need to repair the siding, paint the home and replace her windows. This project will take 2-3 weeks. We will only be in her unit intermittently for a couple days as needed for the windows. She will have about 8-12 days of disrupted weekday time.

she is very upset because she work from home and her dog barks constantly anytime there is anyone hear her property. She requested to leave her lease 2months early because of this. I did let her know that the fact that she work from home and her dog barks constantly is really not my problem to solve, but Im trying to meet her in the middle.

I offered to split the cost of a private worskspace near her home (if will cost her about $200 total). She said she shouldnt have to pay. She wont use a doggy daycare. 

any ideas, suggestion???

The travel hours seems like a major grey zone and Im not going to bank on it. My husband will be REPS and he isnt an agent. He literally only travels to the property to work direclty on it- so it may count (tbd?)

Regarding the hours such as "investor level activities": bookkeeping, education, etc. I have learned that if you are involved in the day to day managment of your properties (which he is) then they can count toward the 750 hours (assuming you hit 500hrs of direct work on the property).

Im trying to breakdown some minor details of what exactly qualifies for REPS hours. I've received mixed answers

1) 500 hour material participation-

-- Does travel to and from the property count? We live out of state and have spent many hours travelling for this reason? - I learned in a real estate tax course that these hours do count. 

--  Due diligence, negotiating, obtaining finanicing of a property that we end up purchasing? 

2) 750 hr: (assuming we have met teh 500 hrs above, what counts for the 250 remaining hours?)

- Once again-- does travel count for this category (if it doesnt count for the 500 hr rule in #1)

- Does real estate education, meet-ups, analysis of potential deals, networking, count -- White coat investor article says NO, however I took a course on taxes/real estate and they clearly say yes, these activites count.
