Hey Jacob, I would recommend top 10 ways to protect your assets (FREE E-Book) by Royal Legal. On their website they put out articles related to real-estate every week as well as have a free group mentoring calls every week, one is called Royal Tax.

Hi @Sarah Hylander,

I would strongly recommend using an LLC to hold the property. The LLC can be incorporated post closing for most properties - I would recommend checking with your lender on when the property can be moved to an LLC.

This can vary depending on your lender. Its recommended that you have a strong partnership document detailing the arrangement but also work with your lender on the best way to incorporate your structure with financing.

Hello @Calvin Schmeling,

The St. Germain act allows you to transfer some properties without triggering the due on sale clause - there are limitations around the type of loan you have, how many units the property are, etc. Recommend chatting with an advisor regarding the specific property to see if the st Germain act will apply

I recommend the DST. The DST allows you have liability protection, minimization, and tax simplification while avoiding extra fees and operational pieces

Hello @Greg Rementer

You would move all operational pieces to your public facing LLC. If the property has less than 5 units and the loan is a typical residential loan, you shouldn't run into any issues with the lender as the st germain act allows you to transfer the property post closing.

Hi @Dan Marl,

Closing into the LLC will likely cause your loan rate to be higher. I recommend closing the refi in your name and moving the property into an LLC post closing
