Congrat and thanks for sharing.

As a Chinese citizen and US permanent resident myself, it is interesting to learn this information on a real estate investment website. I don't know of any Chinese national living abroad ever report  foreign income to Chinese government and I suspect this policy would ever have any material impact on US real estate market.

I want to evict him while he is at hospital (he's been there for almost 4 months already) but not without talking to him. I already put eviction on the table when talking to him through text message he responded at first now he's just completing ignoring it. The tenant is the one I am afraid will stop all communication at some point and just use my property as free storage and his medical condition as a excuse of doing so. I think the only option now is to speak to an attorney to discuss my options. Thanks

A tenant in my rental property was recently involved in a car accident and he's seriously injured and hospitalized from this accident. The tenant is now disabled and unable to work. The only income source this tenant has is probably from government disability subsidy and insurance check. I do not know the exact amount he is getting and I doubt he is willing to share. The tenant is 30 days behind on rent and it doesn't seem like he is going to catch up with his payment due to lack of income. My question is: Can I evict my tenant in this situation? My concern is if I will be in any legal trouble evicting a tenant while he is reasonably unable to respond to my pay-or-quit notice due to his medical condition. If I can, how should I proceed with eviction? Here's another piece of information, my property is in Virginia. The tenant is currently hospitalized in North Carolina where he got this car accident.

Thanks for the quick response William.
The wife's annual income is around $50k and month rent is $1250. She should be fine on her own by my measure. Pros here feel free to pitch in otherwise regarding this financial qualification. I might have problem to hold the husband to the end of current lease as new lease just started 1/1/13. They are renewing tenant so this is not a new couple I just signed up. Should I write them a complete new lease or simply a amendment stating husband is released from the lease? Great point on security deposit entitlement. I certainly want to get that in writing for future conflicts. Thanks!
