I am working with a homeowner that is in foreclosure. I'm putting together a short sale for him and noticed that there are several liens for child support. Do these liens have to be paid off before the home can be sold?

I am wondering if I have to give a down payment to a homeowner for a contract to be legal in New York State. Can all funds be paid out at closing?
