For what it's worth, here's an updated status / "conclusion" for those interested:

The tenant and her mother moved out without a hitch. No legal action was required. This could have been a simple case of luck.

Yeah, I should have noticed it early. I was shocked. I am around the property all the time (maintenance, yard work, etc), and apparently this mom has been living there for years!

I agree, waiting until June is not ideal.

But can I file an eviction on a person not on the lease?

Thanks Mike, that sounds like the only reasonable path I see right now.

Hi Jim, the tenant is not the issue, she's willing to move out. If I evict her, her mom (sublettor) will still be there. In other words, if I evict my tenant, the process takes about 3 months and it will results in the same outcome: main tenant leaves, but the mom just stays.

The mom (aka sublettor) is not on the lease. I dont think I can evict someone who's not on the lease while a tenant is still residing there (perhaps I am mistaken?)

PS From by understanding, she's not a squatter since she did have an agreement with the tenant (although in violation of the lease). She has receipts to prove that she paid rent to the main tenant.

Hi all!

I have a unique tenant situation, to say the lease (pun intended). The property is located in the tenant-friendly state of Massachusetts, in the city of Boston.

I have a lease agreement with a tenant that ends in the end of June. She's planning to move out. However, I didn't know until this last weekend that she has secretly subletted a room to her mom (in clear violation of the lease). I finally spoke with the mom, and she conveyed the message that she (even though the rest of the family will leave) will not vacate the property at the end of the lease. Money and arguing hasn't persuade her to change her mind.

I am not sure what to do. I have a tenant that is cooperative but a subleasor who is not. Is my only option to wait until the lease ends in June (tenant leaves) and then evict the mom through the court process?
