Check the plans.  Spiral stairs do not have landings at every turn.  That would defeat the purpose of a spiral. The information I had provided was from the 2012 IRC code book.  Not sure if they are applying the IBC or IRC in your case.  The requirements are similar but not exact.  Find out what code is being applied to your project.  You can see the code states the minimum width is 26 inches.

Here are a few pictures of the staircase in question.   Bottom pictures have a couple sample measurements.  Not the required 7.5" length.   The inspector also mentioned wanted a 36"x36" landing at every turn, which there is no room for.

I am in need of some advice.  I purchase a rental property with a 3rd floor unit that was in the middle of a rehab.   I called the city inspector, and he visited.  He said he wouldn't provide a Certificate of Occupancy becuase part of the stairs doesn't meet code.  The stairs in question are in an enclosed private entrance.  They are spiral and made of wood.  They are totally acceptable to use for getting up and down to the 3rd floor.  The inspector said they are not wide enough and that 36"x36" landings must be added, which there is no room for.  Any advice would be much appreciated.

That's awesome!   Do you own a duplex or renting rooms in a traditional home?

Thanks Jamie!  I used primary home financing.   I am living in part of the property and house hacking the rest.

Hello all!  I've been listening to Bigger Pockets Podcast now for a year.   I'm a new owner of a mixed use property in Detroit, specifically Hamtramck, MI.   The property has a 1700 sq ft commercial storefront(for lease), 950sq ft garage(rented), 2nd floor 2bd apartment(rented), and a 3rd floor studio apartment that I am buidling out.    I'm new to real estate investing, so I am learning a lot!  Would really like to meet other investors!    -Rick
