It's incredible the amount of energy that is spent trying to "circumvent" the system. I'm sure Keating and Maddoff thought they were only circumventing the system and not doing anything wrong, and did so for many years until someone showed them the error of their ways.

@Edgar - A short sale hits just as hard as a foreclosure on your credit score. It's the eligibility for a purchase after that is different and more favorable to a short sale.

@Phil -

  • The short sale stays on credit for seven years too.
  • yes we do give consideration to what we will yield in a short sale versus foreclosure in the decision making process.
  • Relocation has no material impact unless it is military in the decision making process.

no. Well...anyone can go to the bank. No one will be able to take over payment on an abandoned house. Plain and simple.

It would be exactly that...a roll of the dice. It's not so unlikely for the lender to act on the clause and, it's not an interfamily transfer or for the purposes of estate planning so, if you want to put thousands of dollars out of your pocket and roll the dice and take the chance the lender won't call the note due, that's your call. I can tell you from experience, we accelerate quite often when this is attempted with one of our loans.

If your gonna be blatant about it, why try and pretty it up with a land trust? Just do it and hope the lender doesn't call the note due.

Just in case anything thinks the lender won't check...google, "Minerva Sanchez" in the Modesto/Stockton area. She's in Federal Prison for short sale fraud. P.S...I was the lender.

They won't provide that information without 3rd party authorization from the borrower but if they did provide you that, yes.

buy it... that's how you can, "be able to get the house". That's the answer to your question but I suspect there is more to your question and if so, you'll have to elaborate on your plan before you can get an answer more usefull than the one I provided.

title searches are only going to show the original lien, not the outstanding balance. No one is going to tell you the outstanding balance on any lien on title unless you get a payoff demand or, get the amount from the lender/servicer or owner.

Not gonna happen without an agent. Not gonna happen without being listed on the MLS. The objective is to expose the property to the market (Hence MLS) and mitigate any potential appearance of a non arm's length transaction (Hence the Realtor).
