We invest in Maryland (which is where our LLC is registered) but we're considering doing a flip in Pennsylvania. To avoid the non resident withholding tax, do people usually create a new LLC in the state in which they're investing (so in this case, should we create a new LLC in PA to avoid paying the non resident tax when we sell the flip?) Or is there another way we can avoid this tax while still investing under our MD LLC?

We are looking at a property to flip and were notified of an encroachment...the front porch extends 5 feet further than it should. This is documented on the title as well. Other investors have passed on the property but we're wondering how big of an issue this could potetnially be? We have no plans to extend the house/porch but if the porch is covering some sort of utility lines, what does that mean for the property itself? Would they just tear down the porch if they need to get to those lines (at the owner's expense)? Are there any other risks that we should be thinking of? Does it affect buyers who want to use an FHA loan? Just wanted to know if others have run into a similar situation or any advice.
