Hello Theresa, absolutely, with unpaid rent the eviction could of started. If it were me dealing with it I would have started it. As for the security deposit I also agree. This whole think feels sketchy for lack of a better term to me. If there were any serious damage and if the rent isn't paid by the time she leaves I fully expect my property manager to attempt getting the money. As of now I have no reason to believe she will pay for march.

Wow, this is quite a bit of replies, definitely didn't expect this for my first post! I should've of created an account here a long time ago :)

I thought I'd start by clarifying a few things. As far as I can tell my PM doesn't suck, I just think we might not see things the same way. 

In Nova Scotia if money is accepted once a fixed term lease is finished it converts to a month to month. From there I cannot evict the tenant for lack of having a lease.

My PM did say that he can take the damage deposit(worth 1/2 month rent) for that half month the tenant is staying after the lease once she leaves. He also told me if the tenant doesn't leave by the 15th he will start the eviction process.

As said in my previous post I will let it go till the 15th as my PM recommends as well as others here, both because it doesn't seem to be clear cut and also because I should probably of let him know in advance to file for eviction in this case.

If something similar happens again however I will make sure he starts the eviction process on the 1st.

Hello Jeff, thank you for the reply, I live in NS Canada, I think the costs are a bit lower here. I would of started eviction procedures right away in fear of wasting time with the tenant not leaving and not paying. But what you are saying makes sense. I guess waiting to see how it plays out for now is the better option.

I Hired a property manager 1 year or so ago. They do a good job for the most part. At the moment theres a tenant I want out. I told the property management I didn't want to sign a fix term lease with the tenant again. The tenant has know for more then six months. The tenant didnt pay march rent and their lease ended at the end of march. The tenant refuses to sign a 15 day extension the property management offered them. The tenant says they will move out on the 15th. No money has been collected since February rent and the property management is trusting the tenant will move out. This tenant has a lengthy history with me and them of just lying. Am I wrong to think they should of started doing something to get them out yesterday?
