btw - lesson learned with staying on top of leases, also, charging slightly more than one months rent for the security deposit is a great idea... will definitely be doing this from now on.

Thank you all for the wonderful advice - I was able to craft up a letter and delivered it personally. They called and paid my parents the same day. Much thanks to you all and the forum community!

Thanks for the speedy reply, it is in Northern Virginia in Alexandria. Are there templates within this forum for the letter? (e.g., what needs to be included in it besides the fact that they are late on rent and we are asking for the rent?)

Hi all,

Hope you can help. I am in Northern VA and my parents rent out a townhome- in the past they used a lease, but since it expired, they have never sent the tenants a new lease for renewal. Now, they want to leave, and use the security deposit as the last months rent. I know for a fact that this is not legit, but they are not under a lease. How can I lawfully get them to pay?
