You may ask the city for a change of plan, it would delay your project for a couple of months. You might.have to pay additional fees to the Archtect to redraw the plan, and additional plan fees. But that’s how I would do. Good luck with your project.
I am in the middle of doing an ADU myself, I hope to have it done by July.

@Justin R, thank you for your information, I did ask the inspector who came out to my house, he said the high occupancy house regularly is being challenged in court , therefore it’s not enforced.

Hi everyone, we are a family of three lived in a 5 bedrooms in San Diego. Currently we rented out three spare rooms to 4 unrelated people as roommates. My next door neighbor is not happy about that for whatever reasons. My questions are:
1) how many roommates am I allowed to have legally?
2) How do the city even enforce it if four roommates are too many?
3) if someone from the city came out to check, can they get in the house if I don’t want them to?

Hi Brock, thank you for your response. Maybe I didn’t mention in the original post, but the Construction was actually permitted by the city. The only thing not permitted is a wet bar and some kitchen cabinets. I place a hot plate there for the residents do some light cooking. The property are rented to a total of 5 people, do you think I might run in some risk with insurance in case of fire, for I fear the most.

To Steve S, thanks for your detail scenario. It did changed my thought about the tenant. I just went over to talk to him, we are agreed that he will hire some to replace the exact same. To my surprise he even asked if he can sign a six month lease. I don’t know if I want to do that, but I will not terminate his lease for now. With this tenant, I think I’d rather keep a month to month lease just in case.

Hi Bp. I just finish a rooms additions to my single family house in San Diego. The house was originally a 2bed/2bath, 1008 sf. After the addition, it has 4 beds/4 baths. The new addition and the original house is separated by a door. This way it can be considered as 2 different units if I keep the door locked.. (My house is on R-1 zones.)
My questions are:
If I decide to rent the front part of the house to someone , and rent out the newly built partnof the house to a couple different persons as room rental, is it legal for me to do that? (The room addition is permitted). If not, what kind of troubles it could happen to me?
Second, I plan to use a hot plate for the roommate to cook, since there is no kitchen in the new part of the house, but I have a sink in the commo area. Would I run into into home insurance issue? The reason I decided to rent out as separate units because of significant more cash flow vs. renting it out as a 4b/4b house.
Please give me your thoughts and advice. Thanks.

To John Meirose, thanks for your advice. I think I’ll just let the lease ends first, then I’ll see how it works out.
