If the value is about $175,000, and you can get it from the estate for $62,000, get a contract signed TODAY.  It will take 30 to 120 days for the sale to close, giving you time to line up a buyer for a flip, or to get hard money financing.  As you have presented it, if the administrator is willing to sell the houses and land for $62,000, the other debts are not your concern.  The estate may have other cash assets, to make up for any shortage from the sale of the property.

This could be complicated, if mom is on title, and/or was the wife of the deceased at the time of his death.  If there is no will, the aunts and uncles may or may not be in line for proceeds, depending on wife's status.  And, minor children, in most cases, can not sign legal documents on their own.  This one will require some sorting out.

There needs to be a personal representative, or other person "of standing", in order to proceed with any action on behalf of the deceased.  Try to get a copy of the Death Certificate.  The declarant, if other than a county official, may be a person with more information about any heirs.

Often the son will live there for years, in a free and clear house, and never even file a probate. There may be no motivation for him to sell, since he is living in the house for free. Send a mail piece every 4 to 6 months. By the way, it is a federal offense to open another person's mail box, if you are not a postal employee.

@Jonathan H. They weekly price is the same for all counties, some of which are up to 25 listings per week, which makes the list very affordable. Email for a count for your county. There is a 50% discount for additional counties.

@Adrian Tilley In some states, a small estate probate can be done with a one page document at the title company, with no publication at all. I have done this several times. Send me an email at [email protected], if you would like a weekly count and pricing.

@Marvin S. Some loans do have a prepayment penalty, if you pay more than 20% of the principal during any 12-month period. A typical prepayment penalty would be an additional 6 months interest, if you pay off the full loan prior to 3 years.
