Alyse.....yes they are, since they make more money if they can push you into a soil remediation project. For the most part, they almost ALWAYS tell you that remediation is required. The reality is, most of the time, it's not required. Even if your oil tank fails the township inspection, you have options before performing a soil remediation that could save you thousands of dollars.
The proper procedure should be followed depending on what is seen during the removal process. Obviously, if you have free floating oil in the ground, soil remediation will be required. This doesn't happen that often. Most of the time, you will have holes in your tank and a very min amount of soil contamination that is below the NJDEP clean up standards.
In this case, you should sample the excavation too see what levels of contamination exist. If it's below the clean up standards, the company can write up a report and submit for NJDEP review to close out your case.
