Thank you for all the great info. We settled out. The owner paid me for everything I invested in furnishing the unit.

The owner has agreed to use his unit as a vacation rental and allow me to manage it. No one from the board is responding to any of my emails/texts. So I'm unsure where I stand. Frankly, I  have no intention of fighting against anyone. Once I earn back what I've invested in the space, I'm happy to walk away. I appreciate your contribution. Thank you for sharing.

Thank you so much! I've asked for access and the head of the board said he is under no obligation to show me the documents. He also said that it does state in the HOA rules and by laws that a tenant may not sublease but how would I know that if the owner didn't tell me and if the board is refusing to give me access to the documents. Do you know how I would go about getting access to them? I've asked the owner of the unit and asked the head of the board.

I rented a condo directly from an owner. I knew nothing about the HOA. I told the owner my intentions of living in it part time and subleasing it part time. He agreed, we signed a lease. I fully furnished the apartment. I then received a phone call from his brother who is on the board of the HOA and he tells me that the owner is not allowed to rent it to someone who is going to sublease. I then speak to the head of the board and he says they will give me a trial lease for 3 months to make sure my arrangement didn't interfere with the integrity of the community. Now he isn't following through and is saying that the board is encouraging the owner to settle out with me. What recourse do I have? Can anyone point me in the right direction please. And all this is happening in the state of Florida is anyone is familiar with Florida law.
