Thank you all for your responses.  The tenants did move out without incident and turned over the keys.  I also have documented correspondence, every email, text message and registered mail receipts. They vacated on the 28th of Feb and I have new tenants moving in this week so the condo is free and clear.  Fortunately, they left before I had to process the eviction through the courts.

I know that they make well above the welfare level, but obviously just don't manage their money correctly.  I don't think that they care about their credit either, as I was foolish to rent to them knowing they had been foreclosed on previously...(they were acquaintances of mine...yes, I know ...never again!!!).  My new tenants I did a full background check on...I have learned my lessons....Now I just want to get paid what is due.  It looks like small claims may be my best bet vs collections and try to get a wage garnishment.  I will try once again to get 75% from them and then take it to the next level.

I have a condo in midtown Atlanta and I had to do an early lease termination due to non-payment.  My tenants moved out as requested and I did not have to go through the eviction process, however there is a well documented 2400.00 owed to me.  I have records of all amounts due, and all correspondence (and facebook photos of their trip to Mexico!!).  I offered to accept 2 installments of 50% each, over a month and they countered with $100.00 a month for the next two years starting in May, which I turned down that agreement.

For those with experience in Fulton County Georgia, what are my best options? Small claims court or a collection agency (or other)?  Really appreciate the feedback from others who have been through this process in this county/state.

Hello.

I am in Georgia. I am looking at buying an investment condo which currently has tenants. The HOA is currently at its Owner/Occupant capacity and the rental rights do not transfer. I was advised that I could set up an LLC and put terms in the lease making the tenant part owner (1%) of the LLC and that this would satisfy an owner occupant requirement. At the termination of the lease, the tenant would be disassociated with the LLC. I have discussed this with a property Attorney. Any thoughts on this?
