I am on a H1B visa and my SSN is "VALID FOR WORK ONLY WITH DHS AUTHORIZATION." I have been in US for 3 years now and have established a good credit score over this time period.

I recently applied for an apartment rental and have been asked for a one month security deposit (which is otherwise Zero for other applicants) because the background check company approved my application with "conditions". When I asked the reason for the conditions, the background check company gave me a simple answer - "you are a non-citizen"

Isn't this illegal as per the Fair housing act? As they are basically discriminating me because of my immigration status?

FYI: I have rented with 2 more apartments in the past and never faced any such issue.
