Hi Everyone,

I sent a 90 days notice to one of my tenants starting from 11/09/20-02/10/21.But now i now i feel like she is not goona move by then so i contacted a lawyer and he said the notice that i sent is not valid beacuse 90 days has to start from the beginning of the month.He said the judge would deny the notice beacuse it was incorrect.Is it true that i would have to give 3 full months instead of 90 days? beacuse everywhere i read it says 90 days not 3months that equals to 90days.Please help

FYI-The tenant has been living in there for 3 years and NY requires 90 days.Also, I need to get done some work in the property and i cant do it until it’s vacant.

Thank you so much. Eviction is currently suspended in NY until January 1st and I sent her 90 days notice already in last month which ends in January.Given the current situation can I still send her the notice to send me the rent asap or else 90 days period will be shortened?

@Judy Parker Thank you so much for taking your time and responding.I am new in this business and I get worried easily.I dont mind if she is trying to use the security deposit.I wish these tenants could think about our situation.Its very disrespectful when someone don’t respond.They wont understand what we go through until they own their house and have a tenant in their house.

@Judy Parker NoπŸ˜’πŸ˜’πŸ˜’ I sent her the 90 days notice last month beacuse it needs some repair and i cant work until the unit is empty.She texted me last week asking for a letter that she has paid the rent for oct and nov so that she can show it to the new landlord and I sent it to her the next day.After i sent her the letter she told me that she would send me the rent on the 3rd.But now she is not answering or responding to the text messages.πŸ™πŸ™πŸ™πŸ™

@Bjorn Ahlblad Thank you so much for your reply.I will definitely do that.But the other problem with this tenant is she dosent open the door.I am so frustrated.I am willing to help her but I am not sure why someone tenant gotta be like thatπŸ˜”πŸ˜”
