So if the money is in your account, the bank usually only needs to see statements that go back 60 days and the money will appear as though it were always there.Just to be clear, lenders don't allow Credit to be used as a down payment since that's essentially defeating the purpose.

The principle is what you need to take away ( Use HELOC money to pay your bills, deposit your income back to HELOC balance, Occasionally use HELOC money to pay extra principle on a loan, and repeat).You are gonna have the extra bill of the HELOC payment but Long Term you will have a lot a interest that you're defeating by paying principle off early.

A broker told me that there are actually sellers who want to sell, but don't want to take the tax hit and buying or exchanging into another property at the current prices defeats the purpose of selling.

I believe you could purchase an off market deal, than as soon as title cleared begin to market the property as you would now own it, but if you can just double close it would defeat the entire intent of law which btw is something courts will often look at during cases about interpretation of laws, what was the intent?
